The Divorce process is divided into two procedures. The vast majority of divorces within England and Wales are dealt with by what is known as the 'Special Procedure'. This process sees divorce dealt with by the courts on an administrative basis, with documents filed at court but without the need for you or your spouse to attend court.
A relatively small number of divorces each year are 'contested' or disputed. In these cases the divorcing couple (often referred to as 'the parties' to the divorce) will be required to file evidence at court and to attend court hearings. Defended divorces can be expensive and stressful and should therefore be considered carefully, in order to decide how best to proceed.
Generally a divorce will take between three to six months from start to finish, where there are financial matters to resolve, it may take longer.
