Deregulation Act 2015 applies to all tenancies from 1 October 2018

Landlords, as you will know the Deregulation Act 2015 caused alarm, when it was introduced for all tenancies arising from 1 October 2015. As from 1 October 2018 the Act will apply to ALL tenancies, regardless as to whether they commenced before the introduction of the Act.
Since introduction, case law has provided certainty as to the interpretation of certain parts of the Act and the result is that a failure to undertake certain steps before commencement of the Tenancy could result in the inability to recover possession using the section 21 procedure. Some breaches cannot be rectified retrospectively, and therefore remain a continuing breach. This could be detrimental to you and your portfolio of properties.
Some of the most vital requirements relate to Electrical Performance Certificates and Gas Safety Certificates and therefore it is imperative that you are fully aware of the requirements of the Act so as to not fall foul.
